Description of proposal
CPB Contractors and John Holland in a joint venture (CPBJH JV) are providing design and construction services for the West Gate Tunnel Project (WGTP). The CPBJH JV is building a Shared User Path (SUP) bridge, known as Bridge 75, north of the existing CityLink off-ramp within the City of Melbourne. Under Schedule 73.03 of the planning schemes, an SUP is defined as use for ‘Informal outdoor recreation’. Due to a design change, most of the SUP is within the approved Project Land Boundary, except for two locations of the permanent structure that fall outside of the project land. Under Clause 62.02-2 of the Planning Schemes, the construction of a building or the construction or carrying out of works on land in respect of bicycle pathways and trails is exempt from a planning permit. However, the proposed use of land for ‘Informal outdoor recreation’ triggers a planning permit.
